Air Permits: Major, Minor and the Synthetic Minor Limit
A source is classified by what it could emit running flat out, not by what it did emit last year. That single convention decides whether a facility files a short state form or enters the operating permit program, and it is why an enforceable production cap is worth more than a good operating record.

The rule in short
Potential to emit is maximum capacity to emit a pollutant under the physical and operational design of the source, counting only federally enforceable limits as restrictions. A source is major at one hundred tons per year of a regulated pollutant, or ten tons of a single hazardous air pollutant or twenty-five tons of a combination, with lower thresholds in nonattainment areas. A source may accept an enforceable limit to stay below a threshold and be permitted as a synthetic minor.
Air permitting begins with an arithmetic exercise that has nothing to do with how a plant actually runs. Potential to emit is the maximum capacity of a stationary source to emit a pollutant under its physical and operational design. The calculation assumes continuous operation at full rate, and only limitations that are federally enforceable — on capacity, hours, throughput, fuel or material — count as reductions. A facility that runs one shift is classified as though it ran three.
Where the thresholds sit
The general threshold is one hundred tons per year of any air pollutant subject to regulation. For hazardous air pollutants the numbers are far lower: ten tons per year of any single listed pollutant, or twenty-five tons per year of any combination. Those two figures come from section 112 and they operate independently of the hundred-ton figure, which is why a small solvent user can be a major source while a much larger combustion unit is not.
Nonattainment areas lower the bar further for the pollutant in question. Where an area is classified for ozone, the major source threshold for volatile organic compounds and nitrogen oxides steps down with the severity of the classification, reaching well below one hundred tons in the worst-classified areas. A source minor in one county can be major across a boundary line with identical equipment.
Preconstruction review uses its own numbers. For prevention of significant deterioration, a major emitting facility is one with potential to emit one hundred tons per year if it belongs to one of the listed source categories, and two hundred fifty tons per year otherwise. Modifications are tested against significance levels set pollutant by pollutant, so a change can trigger full review without the source changing class.
Why only enforceable limits reduce the number
Potential to emit is calculated at design capacity because anything else would be unverifiable. An intention to run at half capacity is not enforceable, so it does not reduce the number. A permit condition capping annual throughput, backed by recordkeeping and a monthly rolling total, is enforceable and does.
That is the whole mechanism behind the synthetic minor. The source accepts a limit — hours of operation, tons of material processed, gallons of coating applied, sulfur content of fuel, or a direct emissions cap — sufficient to keep potential to emit below the threshold, and the permitting authority writes the limit into an issued permit along with the monitoring that makes it checkable. The source is then permitted as a minor source, with a shorter application, fewer ongoing obligations and a lower fee.
The trade is a real one. The limit binds, and exceeding it is both a permit violation and an admission that the source has been operating as an unpermitted major source. Facilities that take a synthetic minor limit and then grow into it are common enforcement targets.
Emission units are aggregated into a single source where they are under common control, sit on contiguous or adjacent properties, and share the same two-digit industrial classification. All three prongs must be satisfied. Facilities frequently treat a leased parcel across a road, or a support operation with a different classification, as a separate source and calculate potential to emit twice. Whether adjacent means physically proximate or functionally interdependent has been contested, and the answer has not been uniform across circuits.

The two major columns are separate programs that often apply to the same facility. Preconstruction review controls what may be built; the operating permit collects every requirement applying to what was built. Neither substitutes for the other.
The deadlines that structure the program
An operating permit application is due within twelve months after the source becomes subject to the program. That clock runs from the triggering event — startup of a new major source, a modification pushing the source over a threshold, or the effective date of a standard that brings the source in — not from the moment the source realizes it applies.
A permit runs for a fixed term not exceeding five years. Renewal applications must be submitted at least six months before expiration and, under the federal rule, no more than eighteen months before; states may narrow that window. A timely and complete application carries an application shield, so the source may continue operating while the authority acts. An incomplete application does not, and the shield is lost if requested information is not supplied by the deadline the authority sets.
Annual compliance certification is the other fixed obligation. The responsible official certifies, on personal knowledge and inquiry, the compliance status of each permit term. That certification is the document most often used to establish knowledge in an enforcement case.
Changes, modifications and the review they can trigger
Changes at a permitted source fall into tiers: administrative amendments for corrections and ownership changes, minor modifications for changes that do not violate a requirement or relax monitoring, and significant modifications requiring the full application and public participation process.
The harder question is whether a physical change or a change in the method of operation triggers preconstruction review. That test compares projected actual emissions after the change against a baseline, and a projected significant net emissions increase pulls the change into review with its control technology analysis and, in nonattainment areas, its offset requirement. Routine maintenance, repair and replacement is excluded, and that boundary has produced years of litigation.
Facilities that also handle regulated wastes or wastewater carry parallel programs on separate clocks, including the water discharge permit rules and the accumulation limits described in the generator category duties. A federally funded or federally permitted project may also require the analysis set out in the three levels of environmental review. Where a source finds a permitting error on its own, the disclosure route in the audit policy conditions is worth evaluating before the next inspection.

Questions readers ask
Can a source drop out of the operating permit program after emissions fall?
Not on actual emissions alone. Classification follows potential to emit, so a facility that cut production but kept the equipment capable of higher throughput remains major. Leaving the program requires either removing or permanently disabling capacity, or accepting an enforceable limit that caps potential below the threshold. Until that limit is written into an issued permit, the source stays in the program, files its compliance certifications, and pays the fee based on emissions.
What is an insignificant activity, and can it be ignored?
State programs designate certain small emission units as insignificant, so they need not be described in detail in an operating permit application. The designation is administrative rather than substantive. Emissions from those units still count toward potential to emit and toward major source determinations, and applicable requirements still attach to them. Treating an insignificant activities list as an exemption from the underlying standard is a recurring error, and it usually surfaces when the unit is inspected.
Does a permit protect a source that was built without preconstruction review?
No. Preconstruction review and operating permits are different programs with different triggers. An operating permit records the requirements that apply; it does not cure the failure to obtain a construction permit before building or modifying. Where a modification should have gone through review and did not, the exposure runs from construction and is not extinguished by the later issuance of an operating permit that lists the unit. The remedy is usually a permit issued after the fact, with penalties and often with controls.
